Expungement

Northwest Indiana / Lake County Expungement Attorneys

Indiana law permits expungement of prior convictions under certain  circumstances.  Indiana recognizes the challenges that a criminal  record can create - from difficulty obtaining loans, to issues with  finding jobs, even problems getting an apartment.  Robbins and Seville is here to help you succeed in removing your criminal record.  Indiana Code 35-38-9 et seq. provides a roadmap for removing the burden of a conviction from your record.

Misdemeanor Expungement

Eligible for Expungement if:

  • 5+ years have passed (can be shorter if prosecutor agrees)
  • No further convictions or new charges pending
  • All obligations under the prior misdemeanor have been completed
  • No exceptions apply (ie. unlawful use of a deadly weapon)
  • If qualified, the Court must grant expungement

Felony 6 - Expungement

 Eligible for Expungement if:

  • 8+ years have passed since conviction (can be shorter if prosecutor agrees)
  • No further convictions or new charges pending
  • All obligations under the prior misdemeanor have been completed
  • No exceptions apply (ie. unlawful use of a deadly weapon)
  • If qualified, the Court must grant expungement

Expungement of Other Felonies - Less Serious

  Eligible for Expungement if:

  • 8+ years have passed since conviction (can be shorter if prosecutor agrees)
  • No further convictions or new charges pending
  • All obligations under the prior misdemeanor have been completed
  • No exceptions apply (ie. sex or violent offender)
  • If qualified, the Court may grant expungement

Expungement of Serious Felonies

   Eligible for Expungement if:

  • 10+ years have passed since conviction (can be shorter if prosecutor agrees)
  • No further convictions or new charges pending
  • All obligations under the prior misdemeanor have been completed
  • No exceptions apply (ie. sex or violent offender)
  • Prosecutor agrees to expungement
  • If qualified, the Court may grant expungement
