Social Security Disability

Northwest Indiana / Lake County Social Security Attorneys

Disability causes an inability to work in your normal capacity, which may be disorienting and discouraging, especially if you lack the income and ability to make up for lost wages and other detrimental impacts created by the disability.  Considering that your disability prevents you from working and obtaining an income, the importance of collecting disability benefits becomes paramount to your lifestyle so that you may continue living as best and as comfortably as you possible considering your disability.  Furthermore, it is equally important to find qualified attorneys capable of helping you quickly and efficiently navigate through the process.  An experienced Social Security Disability attorney can help you determine whether you are eligible to receive disability benefits, and also can help guide you through the time-intensive process from filing your Disability claim, all the way to receiving your benefits.  At Robbins and Seville, LLC, we are attorneys in Northwest Indiana who will act as the attorneys you deserve in order to obtain the benefits you need.

Social Security Disability Programs

The Social Security Administration oversees two benefit programs:  SSDI and SSI.  These two programs differ in a few ways:

  • SSDI requires a qualifying amount of work credit paid into social security.
  • SSI covers low income scenarios as well as disabilities.
  • Both programs however, define disability as either expected to result in death or to last for a continuous period of at least 12 months.  The disability, which can be either mental or physical, must prevent you from working (defined as any substantial gainful activity).

Social Security Disability Insurance (SSDI):

  • Under 24:   Earn six credits in the three years prior to the time you became disabled.
  • 24 to 31:   Earn half of the credits available between age 21 and the time of your disability.
  • Over 31:  Earn 20 or more credits in the 10 years prior to becoming disabled.

Supplemental Security Income (SSI):

  • Applies if you are aged 65 or over, blind, or disabled.
  • Additionally you must have limited income and limited resources.
  • While the income limits often change, as of 2020 those limits are $783 per individual or $1175 per couple.
